Product Standards and Compliance

We are committed to ensuring our products meet appropriate safety and performance requirements for their intended use. Where applicable, our products are designed and tested in accordance with relevant Australian and/or European standards.

 

In some cases, a directly applicable Australian Standard may not exist for a particular product category. Additionally, certain products are specifically designed to meet the functional and practical requirements of early childhood education environments, which may not always align precisely with the scope or definitions of existing standards.

 

In such instances, alternative recognised standards, internal testing, and industry best practices are applied to assess product performance and safety.

Installation, use, and any required safety restraints must be carried out in accordance with the instructions provided.

Variation

PSE reserves the right to amend these Conditions at any time. Any amendments will be effective when we publish the amended Conditions on our Website.

Acceptance of order

By placing an order with us, you are making an offer to purchase goods under these Conditions. We may choose to accept or reject any order. Once we accept your order, a binding contract is formed on these Conditions (“Contract”). Any changes to the Contract must be agreed upon in writing by both parties.

Once accepted, orders cannot be cancelled without our consent. We may grant or refuse consent, and any approval may be subject to conditions.

All goods are supplied subject to availability. If we are unable to supply your entire order, the Contract will remain in effect for the portion we do supply.

We may suspend or discontinue the supply of goods to you at our discretion.

Price

The prices listed in our printed catalogues are accurate at the time of publication but may be changed without prior notice. The most up-to-date prices are always available on our Website.

For goods purchased via the Website, the price payable is the price displayed on the Website at the time your order is placed.

Unless otherwise agreed in writing, we may adjust the prices of goods at any time without notice. All quoted prices are exclusive of GST, other applicable taxes, and delivery costs.

GST

PSE is registered for GST and will issue a tax invoice which clearly identifies the GST component. Schools, childcare facilities, other educational institutions, and most registered businesses will receive a 100% refund of any GST paid when they lodge their GST returns.

Payment Terms – Customers on account

Unless otherwise agreed in writing, payment for goods is due in full within 14 days of the invoice date, without deduction or set-off.

A surcharge of 1.5% will apply to all Visa and Mastercard card payments (including GST and freight) and a surcharge of 2.2% will apply to American Express payments (including GST and freight). No surcharge will be applied to payments made by cheque, BPay or electronic funds transfer (EFT). 

As of 1 October 2026, no surcharge will apply to card payments, in line with regulatory requirements.

Limitation

To the fullest extent permitted by law, all guarantees, conditions, and warranties of any kind relating to the goods are excluded. For goods not ordinarily purchased for personal, domestic, or household use or consumption, our liability for any breach of a guarantee, condition, or warranty implied by law is limited, at our discretion, to one of the following: repairing the goods; supplying a replacement; covering the cost of replacing the goods or acquiring equivalent goods; covering the cost of repairs; re-supplying the services; or covering the cost of re-supplying the services.

Delivery

The delivery fee for each order will vary depending on the type, size, and weight of the goods. PSE reserves the right to charge delivery fees at any time, even if no such fees have previously applied.

You acknowledge that any person accepting delivery at the nominated address is authorised by you to receive the order. If no one is available to accept delivery, we may reschedule delivery at an additional cost, or, with your approval, leave the goods at your premises.

Risk in the goods passes to you upon delivery

All delivery or consignment dates provided are estimates only. We are not obliged to meet these dates and accept no liability for delays arising from any cause.

Damages and Claims

Subject to legislative requirements which cannot be altered by contract, and at our discretion, customers are entitled to receive a replacement or refund or equivalent amount of credit, if they receive goods that are over or short supplied, not ordered, damaged or faulty. Notification must be made to our Customer Service department on telephone number 1300 555 972. Approved returned goods must be received by PSE complete and in the original packaging and condition in which they were delivered to you, for a credit to be issued.

Return of goods

If you change your mind about a product after delivery, we may at our discretion provide you with a refund or an equivalent amount in credit. In all instances we will charge a mandatory Return Freight and Handling Charge of 20% of the invoiced value. Large and bulky items cannot generally be returned for this reason.

A return request must be made to our Customer Service department on telephone number 1300 555 972. All returned goods must be received complete and undamaged for the claim to be processed.

Cancellation of Order

If you cancel an order, you are responsible for any losses we incur, including (but not limited to) lost profits and delivery costs where goods have already been dispatched.

Title

Ownership of the goods passes to you only once all amounts owing for all goods purchased have been paid in full.

Default

If the Contract is ended and you owe us money, the money is immediately payable to us and will incur interest at the Interest Rate. We are entitled to enter your premises and repossess any goods in your possession or control.

Intended Use

Each item of goods is supplied solely for its described purpose and not for any other use. We make no warranty as to suitability for any alternative purpose, unless you have notified us of that purpose in writing before the Contract date and we have confirmed in writing that the goods are suitable for it.

Any products identified as suitable for children should be chosen carefully by an adult and used only under proper adult supervision. These items must be used exclusively by children of an appropriate age. While we may provide guidance on age suitability, the ultimate responsibility lies with the supervising adult, who should consider the individual child’s needs and abilities when making a decision.

Product Warranty

Each item is intended for use only for the purpose described and not for any other purpose. Naturally, any item to be used by a child requires careful adult selection and use should be under proper adult supervision. Items must only be used by children of an appropriate age. Unless otherwise agreed, PSE offers a standard 12-month warranty on all products except for normal wear & tear. A photographic image may be required to support your warranty claim. In the instance that the PSE representative or customer service team deem the product to have been misused your warranty claim may not be honoured.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
